How do I know if I qualify for wrongful termination?
An employer who fires an employee without cause and without giving proper notice is committing wrongful termination. Non-unionized employees who do not have an employment contract that says otherwise should receive about one month of notice or pay for each year they worked. Other benefits may also apply besides one month’s notice. An employment lawyer can help review the severance terms.
If I have been wrongfully terminated, can I sue my employer? Do I need a lawyer to do so?
Yes, you can sue your employer. The Small Claims Court in Nova Scotia allows claims of up to $25,000 for wrongful terminations for non-unionized workers. While we do recommend full representation for this type of situation, at a minimum, you should seek legal coaching.
