Wrongful Dismissal Lawyer

Brookshire Law Office works with Halifax wrongful dismissal lawyer, Daniel Wilband, who serves all of Nova Scotia. He helps employees who face wrongful dismissal or who need assistance with their employment contracts. With years of experience in this area Daniel is well equipped to review your severance package and advise you on how to reply within a week of your termination. After the initial consultation, Daniel will be able to let you know if your case is eligible to be taken on contingency.

Job terminations can be very stressful and traumatic. Sometimes, employers make mistakes that worsen the situation. For example, they may claim they have cause to fire you when they don’t. Another mistake they may make is they may not offer you any severance pay when you deserve it. These mistakes can be corrected, but require action. Our employment lawyers can assist you in getting the compensation you are entitled to.

Often, an employment contract will specify what amount of notice or severance pay an employee will be given upon termination, but sometimes those clauses are not enforceable. If you don’t have a valid employment contract that says otherwise, then you are owed a “reasonable” amount of notice or severance pay. The assessment of what is “reasonable” depends on several factors, such as your age, position, length of service and availability of similar work.

If you have been terminated from your employment, contact our employment lawyers to help determine what you are owed.

Q & A

about Wrongful Dismissal

An employer who fires an employee without cause and without giving proper notice is committing wrongful termination. Non-unionized employees who do not have an employment contract that says otherwise should receive about one month of notice or pay for each year they worked. Other benefits may also apply besides one month’s notice. An employment lawyer can help review the severance terms.

Yes, you can sue your employer. The Small Claims Court in Nova Scotia allows claims of up to $25,000 for wrongful terminations for non-unionized workers. While we do recommend full representation for this type of situation, at a minimum, you should seek legal coaching.
